I.GENERAL PROVISIONS
1. These Terms and Conditions govern the use of the Website
www.underdog.bg and govern the relationship between GORA PRODJEKT
EOOD, with company tax number BG206622541, registered office and address of
management - Sofia, Bulgaria, ul. Ostrets 32, et. 2, referred to as "the Company" and
persons using the online store - "User(s)".
2. Acceptance of these General Terms and Conditions by the Users is
a mandatory condition for the conclusion of a purchase contract between
the Company and the Users.
3. By clicking on the button "I agree to the Terms and Conditions", the User
declares that he/she has read and understood these Terms and Conditions, agrees with
them, accepts them without remarks and undertakes to comply with them.
4. The Terms and Conditions are binding for all Users. The Company
reserves the right to unilaterally modify the General Terms and Conditions, and the changes
shall take effect immediately upon their disclosure on the website
www.gora.eco. We encourage you to carefully read the Terms,
our "cookie" policy and our
privacy policy (collectively, "data protection policies") before
using this website.
II.USER OBLIGATIONS UPON REGISTRATION
5. Users agree and represent that when using the
online store www.gora.eco they will provide true, accurate, current and complete
information when completing the registration form. The Company shall not be
liable for any incorrect/incomplete order in relation to any incorrect, inaccurate, incomplete and outdated information received from
Users.
III. PERSONAL DATA
6. The Company is the controller of personal data in accordance with the
Personal Data Protection Act.
7. By accepting these General Terms and Conditions, the User gives his/her express and unconditional consent
in perpetuity for the personal data provided by him/her to
be collected, stored, processed and used by the Company for
the purposes of the performance of the contract for the purchase and sale and delivery of
ordered goods.
8. The Company guarantees its users the confidentiality of the information and personal data provided to
. The latter will not be
used, provided or brought to the knowledge of third parties outside
the cases and under the conditions set out in these General Terms and Conditions.
9. The Company protects the User's personal data made known to
when completing the electronic form to make a purchase application.
10. Subject to applicable law and these General
Conditions, the Company may use the User's personal data
solely and exclusively for the purposes set out in the contract. Any other purposes for
which the data is used will be in accordance with Bulgarian
legislation, applicable international acts, Internet ethics,
rules of morality and good morals.
11. The Company undertakes not to disclose any personal data about the
User to third parties - state authorities, commercial companies, individuals
persons, etc., except in cases where it has obtained the
User's express written consent; the information is requested by state authorities or officials
who, according to the legislation in force, are authorized to request
and collect such information. In these cases, the Company is obliged to
provide the information under the law.
12. Pursuant to the Personal Data Protection Act, the User has the right
access to his/her own personal data which he/she has entered and/or which has become
available to the Company when using the Site, and for the purpose of
making corrections to the personal data provided.
IV. GOODS AND SERVICES PRESENTED ON THE WEBSITE
13. The online store www.underdog.bg offers a diverse range of goods -
clothing, sportswear, accessories and more.
14. Each product on the site is accompanied by information on price, main
characteristics of the product and additional information designed to help
the User make an informed choice when purchasing
the product.
16. The Company reserves the right to change at any time and without
notice the information published on the Site, including
information relating to goods, services, prices and features of
the Goods. Users shall be deemed informed of said changes and
changes shall take effect from the date of their publication. It is possible that at the
time of placing the order, some of the information on the site may not be
up-to-date or the stock of goods may be exhausted. In all these
cases, the User will be informed at the contact telephone number
or e-mail address provided by the User.
17. All prices quoted on the website are in Bulgarian levs and include VAT.
The cost of postage/transport costs associated with delivery is
charged at the end of each order and is explicitly stated before
confirming the order.
18. For each item offered on the website, the regular price of the item is indicated,
without discount.
19. In cases where for certain goods offered on the site there is
a reduction from the regular price at which the goods are offered, along with the regular
price, the corresponding reduced price shall be indicated, as well as the period for which
the goods will be reduced, not exceeding 1 calendar month.
V. CONDITIONS FOR THE PURCHASE OF GOODS
20. The User has several options for shopping in the Online Store
www.underdog.bg
- Register with a username and password or order without
registration. Registration is completely voluntary and free of charge.
- to choose the "Order" option - in this case the User must fill in
his/her personal data, delivery details and payment method.
21. The User should enter up-to-date, true, complete and accurate data, in
otherwise be liable for inaccurate order execution.
22. The User has the right at any time after registration to change
the data entered, except in the case of an order confirmed and prepared for
dispatch by the Company.
23. The User is solely responsible for safeguarding his
username and password for his online shop account, and for
all actions that are performed by him or by a third party using
the username and password.
VI.ORDERS
24. The user is entitled to order all goods listed in the online
store. When placing an order, the User has the right to choose
the type of goods, their quantity and the method of payment, according to the options offered
on the site.
25. At any time prior to the final confirmation of the order by
clicking on the confirm button, the User has the right to make changes to
the selected goods.
26. The order is considered submitted after clicking on the "I agree to
terms and conditions" button and clicking on the "Complete order" button. Completion of
the order by clicking on the corresponding button is legally binding:
by submitting the order, the User expressly agrees that
accepts the order confirmation email sent to him by the Company for
providing information and confirmation of the concluded contract.
27. The Company sends an email confirming the order or
notifies him of the unavailability of the ordered goods.
28. The sending of the order by the User and the confirmation on
the specific order by the Company are the conditions, in the presence of which
the contract for the purchase and sale of goods from the online store
www.gora.eco is considered concluded. The sending by the Company to
of confirmation of the specific order binds the Company and the User by
the terms of the contract and by the terms of these General Terms and Conditions, as well as by
the relevant provisions of the Consumer Protection Act.
29. The Company shall be entitled to change the prices stated on the Site at its
discretion at any time without being obliged to notify
Users in advance. The User is obliged to pay the price that is indicated on the
site at the time of placing the order, whether lower or
higher than the updated price. In the event of technical errors in the
information published on the website, resulting in the order not
being fulfilled, "the Company shall be entitled to refuse the execution of the order
and shall not be liable for any compensation to the User other than a refund to
of the amounts paid and/or deposited by the User for the cancelled order.
VII. PAYMENT FOR PURCHASED GOODS
30. The User may pay the price of the ordered goods by:
Bank transfer, by debit or credit card
Cash on delivery (by postal money order/bank transfer)
By accepting these General Terms and Conditions, the User gives his/her express
and unconditional consent to pay the Company in advance the entire sale
price of the ordered goods.
31. If the payment method "Cash on Delivery" is selected, the User undertakes
to pay at the time of delivery to the courier making
the delivery, the full value of the goods, together with the delivery price of
the goods specified in the order, in accordance with these General Terms and Conditions.
32. If the payment method chosen is "Bank transfer - by debit or
credit card", the User shall pay the full amount at the time of
order confirmation.
VIII. DELIVERY
34. For orders over 120 BGN delivery is free.
35. The delivery time of the ordered goods is up to 5 (five) working days for
the territory of the Republic of Bulgaria, after receipt of confirmation of the
order.
36. The delivery time for ordered goods abroad is up to 30 (thirty)
working days after receipt of order confirmation.
37. The delivery period may be extended on public holidays and/or
weekends by the period of non-working days.
38. The User agrees that it is possible to extend the aforementioned
delivery period due to unforeseen circumstances beyond
the Company's control.
39. The delivery is made:
For the territory of the Republic of Bulgaria - through the courier company Speedy, to
office or to an address selected by the User
For abroad - through a courier company selected depending on the country, with
tracking number, to an address specified by the User.
40. The Company shall not be liable for inaccurate and/or delayed performance,
where this is the fault of the courier/transport company and/or incorrect or incomplete address, contact person and/or telephone number provided by the User, as well as in other circumstances beyond the Company's control.
41. Upon delivery of the goods, the consumer or the third person designated by him
are obliged to sign the accompanying documents. A third party is
any person who is not the holder of the application but accepts the goods on delivery
to the delivery address specified by the consumer.
42. In the event that the User is not found within the
delivery period at the address specified by him and/or access to the
delivery address is not provided, the contract shall be deemed to be cancelled and the Company shall
be released from its obligation to deliver the goods requested and the User
shall lose his rights under the order for delivery of goods placed by him.
IX. TRANSFER OF RISK
43. The risk of loss or damage to the goods shall pass to the Consumer at
time he or the third party, other than the courier and designated by
the Consumer, accepts the goods.
X. RETURN OR EXCHANGE OF GOODS
44. The User has the right to return the purchased goods within 14 days without
giving any reason, without compensation or penalty, starting from the date
of acceptance of the goods by the User or the third party other than the courier
and indicated by the User.
45. When the User wants to cancel and return the purchased goods it is
necessary to inform the Company before the expiry of the 14-day period.
For this purpose, the User should declare his/her wish in writing to e-mail:
contact@underdog,bg, after which he/she will receive a Return Form. The
form shall be filled in by the User and sent to the Company together with the returned
goods within the aforementioned period. In the Return Form
the User is obliged to indicate the bank account and the holder to which
the Company should refund the amount paid.
46. The Goods shall be returned to the Company in the condition in which they were
delivered to the User or to the third party designated by the User.
The User shall be responsible for returning the Goods in the condition specified.
47. Goods returned within the above time limit shall be accepted by the Company only if
the following conditions are simultaneously met:
The goods are in the original packaging;
All labels are attached to the product;
The goods are not used, soiled or damaged;
The goods receipt with which the goods were received or the electronic
invoice for payment by bank transfer is attached.
48. The User has the right to inform the Company of his/her withdrawal from the
contract and by sending a notice of exercise of his/her right of withdrawal to the Company's
e-mail within 14 days of receipt of the goods.
The User is obliged to indicate the bank account and the holder to which
the Company should refund the amount paid. Upon receipt of the
message, the Company sends the User an email - message confirming that it has received the return email. All
other return conditions listed above also apply in this case.
49. The refund shall be made within 14 days of
receipt of the return form and receipt of the goods by the Company, and where
the User has exercised their right of withdrawal by email, after
receipt of the goods by the Company. Refunds shall
be made only to the bank account specified by the User.
50. The costs of returning the goods shall be borne by the User.
51. Until the returned goods are handed over to the Company, the risk of
loss or damage shall be borne by the User.
REPLACEMENT
52. The consumer has the right to replace the goods already delivered to him and to receive
identical to the returned goods within 14 days from the day of delivery
of the goods. The consumer must state the reasons for the requested replacement. For
to replace the goods received, the User should state his/her wish
in writing to e-mail: contact@underdog.bg, after which he/she will receive an Exchange Form.
The form shall be filled in by the User and sent to the Company, together with
the returned goods within the time limit specified above.
53. Replacement of goods shall be made under the terms of a regular order.
54. In the event that the Company does not have in stock an identical product with which to
be replaced the returned goods and the User does not wish to replace the returned
goods with another, the Company undertakes to reimburse the User
the value of the goods paid by him within 14 days, to the bank account specified by
the User.
55. The cost of replacement of the goods shall be borne by the User.
XI. ADVERTISEMENTS
56. The User has the right to make a complaint to the Company within 14 days
of receipt of the goods. Claims shall be submitted to the Company's e-mail
/contact@underdog.bg /. When submitting the claim, the User is obliged to indicate the subject of
the claim and to provide a bank account , to which the amount paid for the goods
will be refunded in the event that the User refuses to replace
the goods with another.
57. When submitting the claim, the consumer must also attach
the documents on which the claim is based:
- Goods receipt or invoice;
- Documents establishing the non-conformity of the goods with the agreed.
58. The cost of returning the advertised goods shall be borne by
the Company. The Company shall notify the User within 2 /two/ working
days before sending a courier to the User's address for dispatch of
the goods. The User shall hand over the advertised goods to the courier.
59. Consumer complaints shall be considered and resolved within the terms and
under the terms of the Consumer Protection Act.
XII. RIGHTS AND OBLIGATIONS OF THE COMPANY
60. The Company shall have the right at any time, without notice to the User,
when the latter uses the services in violation of these Terms and Conditions,
as well as at the discretion of the Company to terminate, suspend or modify
the services provided in connection with the use of the Site.
61.The Company shall not be liable if for any reason (technical or
other) the User cannot access the Site at any time.
62. The Company shall not be liable for any damages caused to software,
hardware or telecommunications equipment, or loss of data,
arising from materials or resources searched, loaded or used on
in any way through the services provided.
63. The Company shall not be liable for any failure to perform its obligations under
this Agreement upon the occurrence of circumstances which it did not foresee and was not
obliged to foresee.
XIII. CONSUMER'S RIGHTS AND OBLIGATIONS
65. The User has the right to be informed of the status of his
order
66. The user is fully responsible for the protection of his
username and password, as well as for all actions that are carried out by
him or by a third party using the username and password.
The User shall immediately notify the Company of any
case of unauthorised access through the use of his/her username and
password, and whenever there is a risk of such use.
67. The User is obliged to pay the price of his order as announced
on the website www.underdog.bg
